Terms of Service

These Terms of Service ("Terms") govern your use of the EHCPhelp website at www.ehcphelp.co.uk ("the Service") operated by EHCPhelp ("we", "us", "our"). By using the Service or purchasing any of our products, you agree to these Terms.
1. What We Provide
EHCPhelp provides document preparation support for parents in England requesting an Education, Health and Care needs assessment (EHCNA) for their child, or appealing a refusal. Our products include:
- Free Preview - one sample section of the parental views document, written from your answers
- Free Refusal Letter Analyser - checks a council refusal letter against the statutory test (3 uses a day)
- EHCNA Request Pack (£99.99) - a personalised request letter, parental views, evidence checklist, school letter and statutory timeline
- Refusal Appeal Pack (£149.99) - personalised grounds of appeal, rebuilt parental views, tribunal form and mediation walkthrough, evidence bundle checklist, council response guide and deadline timeline
All prices are one-off payments in GBP. There are no subscriptions or recurring charges.
2. Important Disclaimer
EHCPhelp provides guidance and document preparation support only and does not constitute legal advice. We are not a law firm, not solicitors, not a registered charity and not affiliated with any local authority or the Department for Education.
Our documents are built on the Children and Families Act 2014, the Special Educational Needs and Disability Regulations 2014 and the SEND Code of Practice 2015. However, we cannot guarantee any particular outcome. The decision on an EHC needs assessment rests with the local authority and, on appeal, with the First-tier Tribunal (SEND).
If you need formal legal advice, we recommend contacting IPSEA, your local SENDIASS or a solicitor specialising in education law. IPSEA and SENDIASS are free.
3. How Our Service Works
You provide information about your child's needs, school history and circumstances. This information is processed by our system to generate personalised documents framed around the statutory test in section 36(8) of the Children and Families Act 2014.
Your documents are generated within minutes after payment and can be copied, downloaded as a PDF and emailed to you. They are unique to the information you provide, and use placeholders (such as [DATE OF BIRTH]) for personal details we deliberately never collect.
4. Your Responsibilities
You agree to:
- Confirm you have parental responsibility for the child you describe
- Provide accurate and truthful information about your child's genuine difficulties - never exaggerate or fabricate
- Review and adjust every generated document to match your child's actual circumstances before sending it to anyone
- Fill in the placeholder details (dates, names, addresses) yourself before sending
- Not redistribute, resell or share your documents with others for commercial purposes
5. Payment and Delivery
Payments are processed securely by Stripe. We never see or store your card details. Upon successful payment, your documents are generated and made available immediately.
6. Refund Policy
Because our packs are personalised digital products generated instantly upon purchase, we are unable to offer refunds once the documents have been generated and made available to you. This is in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which allow an exception to the 14-day cooling-off period for digital content that has been accessed.
However, if you experience a technical issue that prevents you from accessing your documents (e.g. payment taken but nothing generated), please contact us at support@ehcphelp.co.uk and we will resolve the issue or provide a full refund.
7. Data and Privacy
The information you provide about your child (health, development and educational needs) is special category personal data under Article 9 UK GDPR, belonging to a child. We process it under Article 9(2)(a) - explicit consent - which you give as the person with parental responsibility by ticking the consent box before generating documents. Your inputs are not retained on our application servers after the documents are generated, and we keep no copy of the documents themselves. You can withdraw consent or request deletion at any time by emailing support@ehcphelp.co.uk.

8. Intellectual Property
The EHCPhelp website, branding and underlying technology are our intellectual property. Your generated documents are for your personal use in connection with your child's EHC needs assessment or appeal. You may share them with advisers, SENDIASS caseworkers, the school or family members helping you.
9. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for the outcome of any EHC needs assessment request, mediation or appeal
- We are not liable for any decisions made by a local authority or tribunal based on documents you submit
- Our total liability to you for any claim arising from your use of the Service is limited to the amount you paid for the product
Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence or any other liability that cannot be excluded by law.
10. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will be revised accordingly. Continued use of the Service after changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
